On Wednesday, a Washington-based watchdog group, Citizens for Responsibility and Ethics (CREW), filed a lawsuit on behalf of several voters seeking to prevent former President Donald Trump from appearing on the 2024 ballot in Colorado. This legal action is based on Section 3 of the 14th Amendment and revolves around Trump’s alleged involvement in the January 6 attack on the U.S. Capitol.

Section 3 of the 14th Amendment stipulates that an individual is ineligible for future office if, during a previous term in office, they engaged in insurrection or rebellion against the Constitution or provided aid or comfort to its enemies unless granted amnesty by a two-thirds vote of Congress.

Advocates of this argument contend that Trump’s actions following his defeat in the 2020 election fall within the scope of Section 3. While previous attempts to disqualify Republican candidates based on similar grounds have failed, CREW successfully removed a New Mexico county official convicted of trespassing during the Capitol attack.

The lawsuit against Trump was brought forth by six Republican and unaffiliated Colorado voters, including former state, federal, and local officials. It accuses Trump of inciting and aiding the mob that breached the Capitol. Trump, however, has repeatedly denied any wrongdoing and maintained that he did not incite the rioters.

CREW President Noah Bookbinder explained that the organization filed the lawsuit because it believes it is essential to defend the republic’s integrity.

In response to the lawsuit, a Trump campaign spokesman, Steven Cheung, denounced the effort as an “absurd conspiracy theory” and “election interference,” arguing that it lacks a legal foundation.

A broader campaign has emerged with the goal of preventing Trump from appearing on the 2024 ballot in various states under the 14th Amendment. John Anthony Castro, a write-in candidate for the GOP presidential nomination, has initiated similar cases in multiple states.

Senator Tim Kaine of Virginia acknowledged the unfolding legal battle, suggesting it would likely be resolved in the courts.

Colorado Secretary of State Jena Griswold expressed hope that this case would provide clarity on Trump’s eligibility as a candidate for office. She emphasized that Colorado law does not clearly outline how to consider U.S. Constitution requirements when determining a candidate’s eligibility.

As of now, no candidates have qualified for the presidential primary ballot in Colorado, according to Griswold’s office. Both Griswold and Trump are named as defendants in the CREW lawsuit.
